PLAN COMMISSION MEETING
AUGUST 30, 2004
The meeting was called to order by Chair, Bill Hanson, at 8:10 p.m. following adjournment of the Joint Board and Commission meeting. The Secretary certified the notice had been posted at the Black Earth State Bank, Amcore Bank in Mt. Horeb, on the town web site and on the front door of the Town Hall; also published in the News Sickle-Arrow and Mt. Horeb Mail newspapers.

APPROVAL OF MINUTES
Motion was made by Jim Elleson seconded by Barbara Grenlie and carried to approve the July 26, 2004 commission meeting minutes as presented.
CHANGE IN BUILDING SITE LOCATION APPLICATION TERRANCE AND HEIDI DOYLE
An application from Terrance and Heidi Doyle requesting permission to move a previously approved building site envelop in the SW 1/4 SE 1/4 of Section 17 was considered. A Dane County Highway and Transportation access permit to move the driveway location was attached. A certified survey map showing the location of the new building site with measurements to the property boundaries along with a flood plain map for the surrounding drainage area was distributed. The Doyle property consisting of 13 acres located along highway F is outside zone A of the flood plain thus allowing the building of homes. The parcel zoned RH-3 was not considered to be significant from an agricultural and usage standpoint.
Motion was made by Jim Elleson seconded by Donald McKay to recommend approval of the application to the Board. The vote was unanimous.
REZONING APPLICATION MELODY AND GELFF KETCHUM
An application from Melody and Geoff Ketchum owners of 5.79 acres at 3223 JG North, Town of Vermont requesting a zoning change from Ag 2 and B1 to RH 2 was considered. The purpose of the request was to enable the applicants to comply with Dane County zoning regulations allowing the building of a garage next to their home. A Plat of Survey showing the location of the garage was attached to the application along with a Dane County Erosion Control & Stormwater Management permit.
Motion was made by Jim Elleson seconded by Donald McKay to recommend approval of the zoning application to the Board. The vote was unanimous.
ESTER ZARNDT APPLICATION
The application filed by Ester Zarndt (item 5 on the meeting agenda) was withdrawn following the site visit on August 28 to allow time for her to make some changes in the application.
REZONING, HOME SITE, AND DRIVEWAY APPLICATION GAYLORD MICKELSON TRUST, OWNER DEBBIE & RICHARD GRUNDGEIER AND BERNICE MASON APPLICANTS
When this application was first presented at the Commission's July 26 meeting, action upon the application was deferred to the August meeting to allow time for further information gathering. The applicants were asked to provide the dimensions of the home site envelope to the boundaries of the parcel, to find out if a perk test could be found elsewhere within the parcel, to give further study to moving the proposed driveway beyond the end of the town road and moving the home site to the south.
The applicants responded by providing a map showing the dimensions between the home site envelope and the boundaries of the parcel, a letter from Paul A. Hardy, Certified Soil Testing Septic System Designer stating that very shallow soil conditions 6"-12" were found over the entire parcel with the exception of the site indentified on the SOIL EVALUATION REPORT. At this location, he said, the soil depth was found to be 28"-31" deep, making it suitable for the installation of a mound system. The map also showed that the home site envelope had been moved 20' to the south in response to one commissioners suggestion. The applicants also reported that they met again with Fink Excavating to discuss the possibility of placing the driveway at the end of the town road. They found that the distance to the home site would be 760 feet compared to 750 for the proposed driveway, that the grade ranged from 10 to 13 percent compared to 2% for the proposed driveway and that substantial excavation would be required compared to little or no excavation at the proposed site. Also that a ditch would need to be cut on the high side requiring the installation of several culverts. They were also told that they would have continuous problems with snow drifts in the winter because of the bluffs whereas little drifting would occur on the crest.
The applicants also presented a map placing the proposed home within an envelope measuring 150 x100 at the request of one commissioner. The proposed home 145 x 40 left only 5' in one direction and 30' in the other. Another drawing showed that the envelope currently measuring 200 x 200 would need to be 245' x 140' to allow for the plus or minus 50' difference.
With the submission of this information along with a soil map showing that the soil grades in this parcel are among the least desirable from an agricultural standpoint,
Motion was made by Marian Swoboda seconded by Bill Hanson to recommend to the Board that the application be approved.
Following a lengthly discussion a voice vote was called. Barbara Grenlie abstained from voting due to a conflict of interest, Jim Elleson voted no, Bill Hanson voted yes, Marian Swoboda voted yes, Donald McKay abstained because he was not present at the July meeting and did not attend the site visit. The motion carried two in favor and one opposed.
CORRESPONDENCE
A copy of a letter from Dane County Planning & Development, Division of Zoning dated August 4, 2004 addressed to Brian & Leann Haroldson giving notice of violation, expired erosion control permit, expiring June 15, 2004 was given to Commission members for informational purposes.
VERFICIATION OF HOME SITE LOCATION PRIOR TO ISSUANCE OF BUILDING PERMIT
Motion was made by Jim Elleson seconded by Barbara Grenlie and carried to recommend to the board that the town building inspector obtain a copy of all site plans approved by the board and through comparison with county zoning permits verify that the actual placement is correct before issuing the building permit.
ONE YEAR EXPIRATION DATE ON DRIVEWAY PERMITS
Motion was made by Barbara Grenlie seconded by Jim Elleson and carried to recommend to the Board that a one year expiration date on driveway permits be adopted with a $25.00 fee for reinstatement.
LIMITING NUMBER OF HOMESITES PER APPLICATION
Motion was made by Jim Elleson seconded by Barbara Grenlie and carried to recommend to the Board that the number of home sites per application be limited to one.
